In an article published in December of 2018, no lesser of a publication than the Atlantic summarized the social media wasteland as follows: "In America's digital culture, outrage is packaged to almost every niche in the citizenry." That's indisputably correct, and this ethos raises difficult questionsfor employers and human resources professionals. This presentation willdiscuss common employment law issues, concerns, and challenges related toemployee use of social media - both on duty and off duty.
Employers will learn:
- Why the challenges presented by social media are distinct from thosechallenges presented by employee speech in general;
- The extent to which the First Amendment presents limitations on theirability to regulate employee speech or conduct;
- Potential areas of liability risk associated with employee speech; and
- Issues and challenges related to investigating and taking action based onoff-duty conduct.
Andrew A. Cascini is a partner at Henn Lesperance, where he chairs the firm’s employment and labor practice group. Mr. Cascini is a management-side litigator, counselor, and representative. His clients include employers belonging to the automotive, construction, health care, and professional services industries. He also has extensive and specialized experience representing public sector employers, ranging in size from small rural townships to some of Michigan’s most populous counties.
Mr. Cascini helps his clients achieve better employment and labor relations using a holistic, cost-effective, long-term approach. Prior to joining Henn Lesperance, Mr. Cascini worked for a larger firm, where he earned his experience as a key contributor in one of the nation’s deepest and most distinguished labor and employment teams.
Mr. Cascini graduated with honors from both the University of Michigan and Columbia Law School. While attending Columbia, he defended the City of New York against labor disputes brought by some of the nation’s largest public sector unions as a practicing extern in New York City Law Department’s Labor and Employment division.
A second-generation Michigan Man, Mr. Cascini’s favorite things include his daughter Carmella, University of Michigan sports, weightlifting, and a really good shredded chicken taco.
